Hello
In the current version of smart groups, spotlight tags and other field queries are related by an AND. The same is true with search attachments. I was wondering if it could be possible to choose between OR and AND

Right-click on a group (or use the action menu under groups) to select Multiple Selections -> OR.

Please refer to the user guide (Help menu) section on groups for details on all their features.

I was referring to the definition of a given smart folder
For instance if I want my smart folder named "penalized" to contain either papers with the keyword "penalized" or the tag "penalized"

No. Tag searches are always ANDed, unless they are empty in which case they're ignored. The only way I can think of to do what you want is to create two separate searches and then select both (a virtual search). Or make one a smart folder and then other a smart search inside the smart folder. Then use the AND/OR setting I already mentioned to determine how they are treated.
